Many contractors believe that they can avoid paying overtime to employees by paying them on a piece work basis. This is simply not true. Employees who work on a piece work basis are entitled to overtime for all hours worked over 40 in a given week. Overtime for piece work employees is calculated by taking the piece rate and dividing by the number of hours worked. All hours over 40 in a given week must be paid at one and a half times the hourly rate.
