Pennsylvania Piece Work Overtime Claim Lawyers
Many employers hire salespeople on a commission basis. Other industries or trades hire workers as piece-rate employees. Some of these employers believe they do not have to pay overtime to these employees when they work more than 40 hours a week. These actions are against the law. If you work on a commission basis or on a piece work basis and believe you have a claim for overtime, you need an experienced lawyer with a track record of results on your side.
Samuel J. Cordes & Associates is based in Pittsburgh and represents employees across the state in a wide range of unpaid overtime claims. We represent commissioned employees and piece work employees.
We Will Help You Recover the Unpaid Wages You Deserve
Under Pennsylvania law, outside salespeople are exempt from overtime pay. This is not the whole story. Many salespeople are inside salespeople, who are nonexempt, and therefore entitled to overtime. Even inside salespeople who work on commission must be paid overtime if they work more than 40 hours a week. This pay is calculated by dividing the commission by 40 and multiplying by one and a half.
Many contractors believe that they can avoid paying overtime to employees by paying them on a piece work basis. This is simply not true. Employees who work on a piece work basis are entitled to overtime for all hours worked over 40 in a given week. Overtime for piece work employees is calculated by taking the piece rate and dividing by the number of hours worked. All hours over 40 in a given week must be paid at one and a half times the hourly rate.
State and federal overtime rules and regulations are very complex. You need a lawyer who has a complete understanding of how these apply to your situation in order to recover the pay you have lost.
