The Title "Manager" Does Not Always Mean You Cannot Receive Overtime

When you became a manager, you may have been told that you were no longer entitled to overtime pay. This is not always the case. Under Pennsylvania law, managers are only exempt from overtime pay if they meet the following criteria:

  • Primary duties include managing a department or subdivision of a company
  • Regularly direct the work of two or more employees
  • The employee has the ability to hire and fire, or whose recommendations as to hiring and firing will be given particular consideration
  • Perform executive duties 80 percent of the time, or 60 percent of the time in retail
  • Compensated on a salaried, rather than hourly basis

In too many cases, employees who have the title of manager do not perform any of these functions. These employees are therefore nonexempt employees and should be paid overtime.
