New Mothers' Rights

Pennsylvania Workplace Breastfeeding Discrimination Attorneys

Returning to work after the birth of a child can be hard for any mother. It is of course natural for a mother to be concerned about her child's well-being during her return to work. When employers fail to make accommodations they are required to make under the law, or when employers discriminate against new mothers, this can make a difficult situation even worse.

The law firm of Samuel J. Cordes has helped many new mothers who have been victimized by discrimination, retaliation or other unlawful acts in the workplace. Our lawyers have significant experience representing new mothers, and we understand your rights under the law. A new mother's rights come up in a number of different contexts. For instance, in many cases, mothers may require time to care for newborns. Under the Family and Medical Leave Act (FMLA), employers must provide up to 12 weeks of unpaid leave for a mother to do just this.

New Mothers Have the Right to Express Breast Milk at Work. Under the Patient Protection and Affordable Care Act (PPACA), which was recently signed into law, nursing mothers have the right to receive reasonable unpaid break time to express breast milk. Employers must also provide a private space for mothers to express milk.

Further, if your child has special needs, know that under the Americans with Disabilities Act (ADA), discrimination against caregivers to the disabled is illegal. Our law firm recently achieved a successful result on behalf of a mother who was fired for taking time off work to care for her disabled child.

At the outset, it is important to understand that these laws are very complex. Depending on the size of your company, certain laws may or may not apply. Your best chance of seeking a fair resolution is by working with an experienced employment lawyer with a proven track record of results.
